1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your access to and use of the Hashbyt website and any associated landing pages (collectively, the “Site”), including the submission of an application for the free UI Revenue Leak Report (the “Service”).
By accessing the Site, submitting our application form, or otherwise engaging with our Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and “you” refers to that entity.
2. Definitions
- “Hashbyt”, “we”, “us”, “our” – Hashbyt, its employees, contractors, and agents
- “You”, “your”, “User” – any individual or entity accessing the Site or submitting an application
- “Report” – the free written PDF UI Revenue Leak Report delivered under the Service
- “Application” – the form submission through which you request the Service
- “Content” – all text, images, videos, graphics, data, and other material on the Site
- “AI-Generated Content” – any Content created in whole or in part using artificial intelligence tools, as described in Section 9
3. The Free Audit Service
3.1 What the Service Includes
Subject to these Terms and availability, Hashbyt offers eligible applicants a free written UI Revenue Leak Report which includes:
- A manual review of your submitted application URL by a senior Hashbyt engineer
- Comparison against 2–3 identified competitors
- A written PDF report delivered to your email address within 5 business days of application acceptance
- An optional 30-minute walkthrough call (at Hashbyt’s discretion and availability)
3.2 Availability & Acceptance
The Service is offered subject to capacity limits. Hashbyt reserves the right to:
- Decline any application at its sole discretion, including where the applicant does not meet eligibility criteria
- Limit the number of free reports delivered in any given period
- Suspend or discontinue the Service at any time without notice
Submission of an application does not constitute a binding contract until Hashbyt accepts the application and delivers a report or confirms acceptance in writing.
3.3 No Fee
The Report is provided at no charge to eligible applicants. Hashbyt does not require payment, subscription, or any commitment to paid services in exchange for the Report. The Service is offered in good faith as a demonstration of Hashbyt’s expertise.
3.4 Scope Limitations
The Report is a high-level competitive UI analysis based on publicly accessible information about your application and competitors. It is not a comprehensive technical audit, security audit, code review, accessibility audit, or legal compliance review. It does not constitute professional legal, financial, or regulatory advice.
4. Eligibility
The Service is intended for:
- Businesses and professional users operating a software application
- Individuals submitting on behalf of a business entity
- Applicants who can be reached at a valid business email address
The Service is not available to individuals under 18 years of age, to direct competitors of Hashbyt, or to applicants who submit false, misleading, or fraudulent information in their application.
5. No Guarantee of Results
Any outcomes, metrics, or improvements referenced on the Site (including in testimonials, case studies, or marketing copy) represent specific results achieved by specific clients under specific circumstances. They are provided for illustrative purposes only.
Hashbyt makes no warranty or representation, express or implied, that:
- The Report will identify all issues affecting your application
- Implementing the Report’s recommendations will produce any particular business outcome
- The findings in the Report will be accurate, complete, or current at any point after delivery
- The Report will result in improved deal close rates, reduced churn, faster development, or any other metric
The Report is provided “as is” as a professional opinion. You are solely responsible for any decisions you make in reliance on the Report.
6. Intellectual Property
6.1 Hashbyt’s IP
All Content on the Site, including but not limited to text, design, graphics, logos, images, videos, and underlying code, is owned by or licensed to Hashbyt and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, publish, display, or create derivative works of any Hashbyt Content without prior written permission, except as expressly permitted by these Terms.
6.2 The Report
Upon delivery of the Report to you, Hashbyt grants you a non-exclusive, non-transferable, royalty-free licence to use the Report internally within your organisation for the purpose of improving your application.
You may not:
- Share, publish, or distribute the Report to third parties without Hashbyt’s prior written consent
- Use the Report in any marketing, advertising, or public communications without prior written consent
- Claim ownership or authorship of the Report
Hashbyt retains all intellectual property rights in the Report and the methodologies used to produce it.
6.3 Your Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant Hashbyt a perpetual, irrevocable, royalty-free licence to use such feedback for any purpose without any obligation to you.
7. Your Submitted Content
By submitting your application, you grant Hashbyt a limited, non-exclusive licence to access and review your application URL and publicly available information about your product for the sole purpose of producing the Report.
You represent and warrant that:
- You have the right to share any information submitted in your application
- Your application does not infringe any third-party intellectual property rights
- The information you provide is accurate and not misleading
Hashbyt will not use your submitted application URL or business information for any purpose other than delivering the Service and improving our internal processes, in accordance with our Privacy Policy.
8. Website Content & Accuracy
We endeavour to keep the information on the Site accurate and up to date. However, we make no representations or warranties as to the accuracy, completeness, or currency of any Content on the Site.
The Site is provided for general informational and marketing purposes. Nothing on the Site constitutes professional legal, financial, technical, or regulatory advice. You should seek independent professional advice before making any business decisions.
Hashbyt reserves the right to modify, update, or remove any Content on the Site at any time without notice.
9. AI-Generated Content Disclaimer
Some Content on the Site has been created or assisted by artificial intelligence tools. This includes, without limitation:
- Marketing copy and page text – headlines, body copy, and descriptions may have been drafted or refined by AI language models
- Video content – certain videos or portions of video content on the Site may be partially or fully AI-generated, including AI voice synthesis, AI avatars, AI-edited footage, or AI-generated visual representations. Such content is intended to represent illustrative scenarios and is not presented as documentary evidence of actual events
- Profile images and illustrations – some images, including profile photos accompanying testimonials, may be AI-generated synthetic images and may not represent real individuals
- Statistical and outcome illustrations – some numerical claims or outcome visuals may have been produced or enhanced with AI tools for illustrative purposes
Hashbyt does not intend any AI-generated Content to constitute a false statement of fact. Where AI-generated Content is used to represent client testimonials, case study outcomes, or reviews, it is intended as representative of the types of experiences our clients have, not as verbatim accounts of specific events unless explicitly attributed to a named individual with their consent.
In accordance with applicable FTC guidelines, ASA rules, and other advertising standards, this constitutes our standing disclosure regarding AI-generated content on the Site.
10. Testimonials & Endorsements
Testimonials, quotes, and client results displayed on the Site are subject to the following disclosures:
- Testimonials may have been solicited by Hashbyt or its agents
- Some testimonials may have been edited for length, clarity, or grammar
- Some testimonials may be composite representations of common client experiences rather than verbatim quotes from a single individual
- Some testimonials or the profiles associated with them may be partially or fully AI-generated (see Section 9)
- Where a testimonial includes specific performance metrics (e.g., “40% improvement”, “4× faster”), those metrics represent the experience of the specific client referenced and are not typical results
The inclusion of a testimonial does not constitute an endorsement of Hashbyt by any third-party organisation the reviewer may represent, unless explicitly stated.
11. Online Reputation Management (ORM) Disclosure
Hashbyt has engaged, or may engage, Online Reputation Management (ORM) firms or reputation consultancies. Such firms may have facilitated, solicited, incentivised, or assisted in the drafting of reviews and testimonials that appear on the Site or on third-party review platforms (including but not limited to GoodFirms, Clutch, and Google).
This constitutes a material connection disclosure as required by the FTC’s Endorsement Guides (16 C.F.R. Part 255) and equivalent international advertising standards regulations.
Despite ORM engagement, Hashbyt’s policy is that all published reviews reflect the genuine experiences of individuals who have actually engaged with our services. We do not knowingly publish fabricated reviews from non-clients.
The existence of ORM engagement does not mean all reviews on the Site or associated platforms were ORM-assisted. Many reviews are organic and unsolicited.
12. Third-Party Links & Services
The Site may contain links to third-party websites, services, or embedded content (including YouTube videos). These third-party services are governed by their own terms and privacy policies. Hashbyt:
- Does not endorse, control, or assume responsibility for any third-party content
- Is not liable for any loss or damage arising from your use of third-party services
- Recommends you review the terms and privacy policy of any third-party service you use
The presence of a third-party link or embed does not imply any affiliation or partnership between Hashbyt and that third party unless explicitly stated.
13. Limitation of Liability
13.1 Exclusion of Certain Damages
To the fullest extent permitted by applicable law, Hashbyt shall not be liable for any:
- Loss of profits, revenue, or anticipated savings
- Loss of business, contracts, or goodwill
- Loss of data or information
- Indirect, consequential, incidental, special, or punitive damages
arising out of or in connection with your use of the Site, the Service, or the Report, even if Hashbyt has been advised of the possibility of such damages.
13.2 Cap on Liability
To the fullest extent permitted by applicable law, Hashbyt’s total aggregate liability to you in connection with the Site or the Service shall not exceed £100 / $100 USD / €100 (or the equivalent in your local currency), regardless of the form or basis of the claim.
13.3 No Liability for Third-Party Content
Hashbyt is not liable for any loss or damage arising from your reliance on Content that has been created, assisted, or influenced by third parties, AI tools, ORM firms, or reviewers.
13.4 Statutory Rights
Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by applicable law.
If you are a consumer in the UK or EU, you may have statutory rights that these Terms cannot override. Nothing in these Terms affects those rights.
14. Indemnification
You agree to indemnify, defend, and hold harmless Hashbyt and its officers, employees, agents, and contractors from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Site or Service in violation of these Terms
- Your submission of false, misleading, or infringing information in your application
- Your violation of any applicable law or regulation
- Any infringement by you of any third-party intellectual property or privacy rights
15. Prohibited Uses
You agree not to:
- Submit false, fraudulent, or misleading information in your application
- Submit multiple applications for the same business or application URL to circumvent capacity limits
- Use the Site or the Report for any unlawful purpose
- Attempt to gain unauthorised access to any systems or data associated with the Site
- Use automated tools, bots, or scrapers to interact with the Site
- Reproduce, sell, or commercially exploit the Report without prior written consent
- Use the Site or Report to develop a competing service or product
- Transmit any unsolicited commercial communications through the Site
- Interfere with or disrupt the integrity or performance of the Site
16. Confidentiality
The Report and any written analysis delivered to you is provided in confidence. You agree to treat the Report as confidential and not to disclose it to competitors of Hashbyt or use it to disparage Hashbyt in any public forum.
Hashbyt will treat any non-public information you share in your application (including details about your product or competitors) as confidential and will not disclose it to third parties except as required to deliver the Service or as required by law.
These confidentiality obligations do not apply to information that: (a) is or becomes publicly known through no breach of these Terms; (b) was already known to the receiving party before disclosure; or (c) is required to be disclosed by law or court order.
17. Communications & Marketing
By submitting an application, you consent to receiving transactional communications from Hashbyt related to your application and Report delivery. These are not marketing emails and cannot be opted out of without withdrawing your application.
Separate from transactional communications, we may send you marketing emails about our services only where you have given explicit consent or where permitted by applicable law (e.g., the UK PECR “soft opt-in” rule for business contacts).
You may unsubscribe from marketing communications at any time by clicking the unsubscribe link in any email or by contacting us at the address in Section 21. Unsubscribing from marketing will not affect delivery of your Report.
All email communications from Hashbyt will comply with applicable anti-spam legislation, including the CAN-SPAM Act (USA), CASL (Canada), PECR (UK), and equivalent EU regulations.
18. Termination
Hashbyt reserves the right to terminate or suspend your access to the Service at any time and for any reason, including if we reasonably believe you have violated these Terms.
You may withdraw your application at any time before delivery of the Report by contacting us. Upon withdrawal, Hashbyt will delete your submitted data in accordance with the Privacy Policy.
Termination of the Service does not affect any accrued rights or obligations of either party. Sections 6 (IP), 13 (Limitation of Liability), 14 (Indemnification), 16 (Confidentiality), and 19 (Governing Law) survive termination.
19. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.
In the event of a dispute, the parties agree to attempt to resolve it informally in the first instance by contacting Hashbyt at the address in Section 21. If the dispute cannot be resolved informally within 30 days, it shall be referred to the exclusive jurisdiction of the courts of England and Wales.
EU/EEA consumers: If you are a consumer based in the EU/EEA, you may also be entitled to use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr, and mandatory consumer protection laws in your country of residence may apply.
US consumers: Nothing in these Terms constitutes a waiver of any rights you may have under applicable state or federal consumer protection law.
20. Changes to These Terms
Hashbyt reserves the right to update or modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page.
Your continued use of the Site or submission of an application after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the Site.
